Advantage_EAP-R_Counseling_Terms_of_Use
You must agree to the following Advantage EAP-R Counseling Terms of Use prior to using the counseling service.
The following terms are defined in the Terms of Use.
(1)Terms of Use: Refers to the Advantage EAP-R Counseling Terms of Use.
(2)Service Providers: Refers to Tokio Marine & Nichido Medical Service Co., Ltd. and Advantage Risk Management Co., Ltd.
(3)Contractor: Refers to companies, corporations, or other organizations that have concluded a contract with the Service Providers for the provision of the Service.
(4)Provider: Refers to counselors (doctors, certified public psychologists, clinical psychologists, etc.) affiliated with or partnered with Tokio Marine & Nichido Medical Service Co., Ltd.
(5)The Service: Refers to “Advantage EAP-R Counseling” provided to Users by the Service Providers based on the contract concluded between the Contractor and the Service Providers.
(6)User: Refers to individuals who have the right to use the Service based on the contract concluded between the Contractor and the Service Providers, including members (employees, etc.) of the Contractor and their family members up to the second degree of kinship. However, if the Contractor’s member, etc., retires from the contracting company, corporation, or organization during the Service contract period, the Service shall not be provided from the date of retirement onward.
Article 1 (Purpose)
1.The Terms of Use specify matters necessary for Users to utilize the Service.
2.The Service Providers shall provide the Service to Users who agree to the Terms of Use.
3.The Service Providers shall not be responsible for providing the Service if Users do not agree to the Terms of Use.
Article 2 (Nature of the Service)
1.The Service is intended to provide physical and psychological health support to the User and is not a medical practice. The User shall use the Service with the understanding that the Service does not guarantee the improvement of symptoms being experienced.
2.When the Service is used by Users who are currently undergoing psychiatric, psychosomatic, or other such treatment at medical institutions, or who are receiving prescriptions for medication, an approval letter, statement with instructions, or other such document from the doctor in charge of those Users may be requested in advance. In these cases, parts of the Service may become unavailable without agreement from the doctor in charge. If costs are incurred at medical institutions for obtaining or creating documents, Users shall be responsible for these costs.
3.The Service is available in English and Japanese only. However, the Service (including provision of the Service in English) may be partially unavailable depending on the area of residence of the User, the type of Service, etc.
Article 3 (Contents of the Service)
- The Service shall provide consultation, advice, guidance, and other assistance related to various psychological matters, and general knowledge about mental health. The Service Providers and providers, who are experts, shall support Users in solving work-related or private issues. Users may utilize the Service within the scope of the contract concluded between the Contractor and the Service Providers.
Article 4 (Handling of Personal Information)
1.The content of Users’ consultations, etc., may be shared among Providers.
2.Providers may view Users’ stress level checkup results (including various judgment results such as high stress or high engagement) for provision of the Service.
3.Personal information obtained in relation to the Service shall be handled strictly in accordance with the Privacy Policy. Refer to the Privacy Policy in the following section for details.
Article 5 (Necessary Equipment, Software, Applications, Communication Lines, etc.)
When using the Service, Users agree to the following terms regarding the necessary equipment, software, applications, and communication lines (hereinafter, “external tools”).
(1)The preparation, setup, and use of external tools shall be the responsibility and at the expense of the Users and the Contractor.
(2)Users must comply with the terms and guidelines of the external tools.
(3)Prior to using the Service, Users must perform appropriate setup such as installing external tool apps (the version recommended by the Service Providers) and confirm the functionality.
(4)The Service Providers shall not be responsible for any malfunction or issues with the functionality of the external tools.
(5)Users receive files or open URLs sent by the Service Providers through the chat function of external tools at the User’s own risk.
(6)The Service Providers shall not be obligated to respond to inquiries or consultations regarding the use of external tools.
(7)The Service Providers shall not be responsible for any damage Users may incur from the deletion or loss of posted information or other data on external tools, as well as the cancelation of User registration or other consequences of using external tools.
Article 6 (User Information)
Prior to using the Service, Users must register their email address, date of birth, sex, preferred language, phone number, etc. (hereinafter, “User information”), and agree to the following.
(1)Register true and accurate information.
(2)Users shall be responsible for correcting or updating their registered User information.
Article 7 (Management of IDs and Passwords)
1.Users shall be responsible for managing the necessary company ID, registered User ID, and password for login (hereinafter, “login credentials”) and must not allow third parties to use, lend, transfer, change the name of, or sell them.
2.The Contractor or User shall be responsible for any damage resulting from inadequate management, misuse, or third-party use of login credentials, and the Service Providers shall assume no liability.
3.Actions taken using login credentials shall be considered the responsibility of the User holding the respective User ID, including actions by third parties using this information without the User’s consent.
Article 8 (Ownership of Intellectual Property Rights)
1.All intellectual property included in the Service belongs to the Service Providers and the third parties recognized by the Service Providers.
2.Users may not reproduce, sell, publish, or otherwise use for private purposes any information related to the Service without prior consent from the Service Providers and the third parties holding the respective intellectual property rights.
Article 9 (Prohibited Actions)
The Service Providers shall prohibit Users from engaging in the following actions when using the Service. If Users engage in any of these prohibited actions, the Service Providers may suspend the use of the Service for the offending Users.
(1)Actions that violate the Terms of Use
(2)Actions that violate laws, regulations, ordinances, etc. (including saving or transmitting content that infringes rights, defames, or invades privacy through the use of the Service)
(3)Actions that destroy or interfere with the functions of the Service Providers’ servers or networks
(4)The following actions and other use of the Service for purposes other than the intended purposes.
① Reproducing all or part of the systems used in the Service
② Modifying or adapting all or part of the systems used in the Service
③ Analyzing the structure, functions, or processing methods of the systems used in the Service, or attempting to obtain the source code of these systems through tracing, debugging, disassembly, de-compilation, or other means
④ Incorporating all or part of the systems used in the Service into other software, or incorporating all or part of other software into the systems used in the Service
(5)Using the login credentials of other Users to use the Service
(6)Infringing on the intellectual property rights, portrait rights, privacy rights, reputation, or other rights or interests of the Service Providers or third parties
(7)Engaging in harassment towards the employees or Providers of the Service Providers
(8)Engaging in actions that cause discomfort to the employees or Providers of the Service Providers
(9)Tampering with information that can be used concerning the Service
(10)Interfering with the operation of the Service
(11)Other acts of unauthorized use of the Service
(12)Any other actions deemed by the Service Providers to be inappropriate
(13)Acts of audio/video recording of counseling session or capturing images of a session
Article 10 (Revision of the Terms of Use)
1.The Service Providers may revise the Terms of Use after providing notice as specified in the next Paragraph if the following conditions are met. In such cases, Users shall be subject to the revised Terms of Use when using the Service.
(1)If the revision benefits the general interest of Users
(2)If the revision is reasonable and does not contradict the purpose of the Service
2.When revising the Terms of Use, the Service Providers shall notify Users by posting the revisions, their content, and the effective date on the Service site or other sites managed by the Service Providers.
Article 11 (Discontinuation of the Service)
If any of the following takes place, the provision of all or part of the Service may be suspended or discontinued without prior notification to the User. In such cases, the Service Providers shall bear no liability whatsoever, including but not limited to the provision of compensation for damages or losses.
(1)Inspection or maintenance of computer systems relevant to the Service must be performed urgently
(2)System failures, connection failures, mishandling, access traffic overload, unlawful access, hacking or other causes have made the Service Providers unable to operate the Service
(3)Force majeure including power loss and natural disasters such as earthquakes, lightning strikes, fires, windstorms and floods have made the Service Providers unable to operate the Service
(4)Other cases in which the Service Providers deem it necessary to discontinue or interrupt the Service for reasonable causes
Article 12 (Disclaimer)
1.The Service Providers assume no liability for the following damages in relation to the use of the Service. However, this shall not necessarily apply to damages incurred by the User due to the Service Providers’ breach or tortious conduct related to the Service Providers’ obligations defined in the contract with the Contractor regarding the provision of this Service.
(1)Damages incurred by the User as a result of the use or inability to use the Service
(2)Damage incurred by the User due to the revision of the Terms of Use in accordance with the stipulations of Article 10 or the discontinuation or interruption of the Service in accordance with the stipulations of Article 11
(3)Damages the User has caused to third parties as a result of the use of the Service
(4)Interruption, delay or abortion of system operation, data loss, unlawful access to data or any other damage incurred by the User that has been caused by performance issues of the internet communication lines, computers or other hardware or software used by the User
(5)Damages caused by comments or other acts of nuisance by other Users or third parties
(6)Damages following complaints or disputes that are based on the User causing failures such as server failure in relation to the use of the Service
(7)Damages caused by or related to the terminal devices or applications used by the User
(8)Damages that occurred due to anything related to the use of the Service in accordance with the damages stated in the preceding Items
2.The Service Providers shall not guarantee that Users will achieve the results intended by this Service (including, but not limited to, improvements in the User’s mentality management, engagement, mental toughness, or reduction in the User’s stress). Further, even if Users obtain information about the Service directly or indirectly from the Service Providers, the Service Providers shall not provide any guarantees beyond what is stipulated in these Terms.
3.The Service is provided to Users based on professional knowledge in counseling, psychiatry, and psychology. However, this shall not constitute a promise of problem resolution within a certain period for all Users.
4.In crisis interventions where there are indications of the intent to commit suicide or to harm others, the Service Providers shall make every effort to avoid the crisis, but the Service Providers shall assume no liability, including for damages, in the event of any incidents affecting the User, the User’s family, or other stakeholders.
5.The Service Providers shall assume no liability except in cases where the User incurs damages due to the Service Providers’ intentional or gross negligence.
6.The Service Providers shall assume no liability for any transactions, communications, disputes, etc., that arise between the User and other Users or third parties in connection with this Service. Should any of these take place, the User shall resolve them under his/her own responsibility.
Article 13 (Governing Laws and Jurisdiction)
The Terms of Use are governed by Japanese laws and any disputes arising in relation to the Service (including court settlement procedures) shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Supplementary Provisions
The Terms of Use shall come into effect as of 1 April 2025.

Advantage EAP-R Privacy Policy
The definitions of terms appearing in the Privacy Policy shall be the same as in the Advantage EAP-R Counseling Terms of Use.
In undertaking to provide the Service, the Service Providers shall adopt the following measures to protect the personal information of the Users.
Article 1 (Acquisition of Personal Information)
The Service Providers shall acquire and record the following personal information when Users use this Service.
(1)Personal attribute information provided through the contractor, such as User ID, name, date of birth, sex, email address, address, phone number, workplace, department name, position, employee number, etc.
(2)Personal information provided directly by the User or through media such as written documents, including name, date of birth, sex, email address, address, phone number, etc.
(3)Content of consultations and related information provided during consultations (e.g., medical history, upbringing history, names of medical institutions currently attending, treatment status, diagnosis names, medication details, family information, other provided personal attribute information, email documents, paper documents, audio data recording consultation content, video data recording consultation content, etc.)
(4)Responses and results of various surveys, including psychological tests conducted according to the User’s situation
(5)Contents of various documents required for counseling (e.g., daily rhythm tables, service agreement consent forms, consent request forms, attendance consent forms, disclosure consent forms, etc.)
(6)Responses and results of stress level checkup surveys (including various evaluation results) and responses to current status understanding questions
Article 2 (Purpose of Use of Personal Information)
1.The Service Providers shall use personal information indicated in the preceding Article only for the following purposes and shall not use it for any other purposes.
(1)Provision of the Service
(2)Provision of the following related services operated by the Service Providers
① Solution program services for resolving issues of the Contractor and Users
② Various surveys other than stress level checkups
③ Information management related services
(3)Guidance on the use or follow-up, etc., of the Service
(4)Responding to inquiries from Users regarding the Service
(5)Investigation and analysis of the status of usage of the Service
(6)Providing useful information about the Service and other services provided by the Service Providers
(7)Improvement of the Service and other services provided by the Service Providers
(8)Consideration of new services, etc.
(9)Creation of statistical information as usage reports for the Contractor
(10)Creation of statistical information contributing to the improvement of public health, and creation of outside academic review information and case review information with part of the personal information, such as names and User IDs, deleted
(11)Creation of statistical information contributing to the improvement of the Service and other services provided by the Service Providers, and creation of outside academic review information and case review information with part of the personal information, such as names and User IDs, deleted
(12)Creation of case reports and case collections with part of the personal information, such as names and User IDs, deleted
(13)Inquiries to Users related to the results of stress level checkups
2.The Service Providers may provide personal information specified in the preceding Article and information specified in the preceding Paragraph to subcontractors to the extent necessary to achieve the purposes specified in the preceding Paragraph.
3.If it becomes necessary to obtain, use, provide, or entrust personal information of Users beyond the scope of the purposes specified in Paragraph 1, the Service Providers shall do so with the consent of the Users.
Article 3 (Provision of Personal Information to the Contractor)
The Service Providers shall disclose personal information to the Contractor only in the following cases.
(1)When disclosing personal information to occupational physicians or occupational health staff based on the Industrial Safety and Health Act and related rules, regulations, notifications, and manuals (In such cases, the Contractor shall ensure that the occupational physicians or other occupational health staff designated by the Contractor adhere to their confidentiality obligations, and the Service Providers shall not bear any liability.)
(2)When submitting crisis intervention reports in cases in which it is judged that there is a risk of suicide, self-injury, or harm to others, or when reporting/communicating to corporate contacts designated by the Contractor as internal consultation desks for harassment or compliance issues
Article 4 (Provision of Personal Data to Third Parties)
The Service Providers shall not provide Users’ personal data to third parties, including the Contractor, without the Users’ consent. If the Service Providers need to provide Users’ personal data to third parties, they shall notify Users separately in advance and obtain Users’ consent. However, the following cases shall be exceptions.
(1)When required by laws or regulations
(2)When it is necessary to protect a person’s life, physical well-being, or property, and it is difficult to obtain the User’s consent
(3)When it is particularly necessary to improve public health or promote the sound development of children, and it is difficult to obtain the User’s consent
(4)When it is necessary to cooperate with a national institution, a local public body, or a person entrusted by them to execute affairs prescribed by law, and obtaining the User’s consent could impede the execution of those affairs
(5)When the case falls under the matters stipulated in Article 27, Paragraph 5 of the Act on the Protection of Personal Information
Article 5 (Rights of the User)
1.If a User requests the disclosure of their personal data, the Service Providers shall verify the identity of the requester and respond in writing within a reasonable period. (In some cases, actual costs may be charged.) If any errors in the information are found as a result, they shall be corrected or deleted. However, if any of the following cases apply or if the requested personal data does not exist, part or all of the information may not be disclosed, and the requester shall be notified of the reason without delay.
(1)When there is a risk of harm to the life, physical well-being, property, or other rights and interests of the User or a third party
(2)When there is a risk of significant interference with the proper execution of the Service Providers’ business
(3)When it is a violation of other laws or regulations
(4)When the requested personal data does not exist in the personal data held by the Service Providers
2.For disclosure requests as stipulated in the preceding Paragraph, please contact the personal information consultation desk specified in Article 10.
3.If you wish to delete or change your personal data, please contact the Service Providers through the Contractor.
4.Notwithstanding the stipulations of the preceding Paragraph, if you wish to correct or delete consultation details or consultation history, please contact the Service Providers directly.
Article 6 (Security)
1.Use of SSL encrypted communication
The Service Providers use the Secure Sockets Layer (SSL) cryptographic transmission protocol when sending and receiving personal information. SSL is the most common method for encrypting communications between two parties over the internet and is widely used by many websites. By automatically encrypting personal information entered by the User prior to sending or receiving, SSL prevents the theft or alteration of valuable information.
・The nature of the internet means that SSL is not able to completely guarantee the security of transmitted information.
2.Prevention of illegal access
The system used in the Service is equipped with a firewall and uses IP filtering for some information to prevent unauthorized access from outside. The Service Providers also limit access to personal information to certain individuals and pay the utmost and careful attention to the safety of personal information storage.
3.Cyberattacks, etc.
In the event of security risks such as cyberattacks, the communication route may be blocked, prioritizing data protection.
Article 7 (Cookies)
When Users use the Service, the Service Providers shall set the Service’s cookies on the User’s computer. This is done to retain the User’s login information during sessions after logging in and is not used for the purpose of acquiring private information.
Article 8 (Information Management)
The Service Providers shall supervise the subcontractor to ensure that the subcontractor operates and manages personal information in accordance with this privacy policy when outsourcing tasks related to the Service to a third party under the responsibility of the Service Providers.
Article 9 (Revision of the Privacy Policy)
1.The Service Providers may revise this privacy policy after informing Users as stipulated in the next Paragraph in the following cases. If the User uses the Service after the revision, the User is deemed to have agreed to the revised privacy policy.
(1)If the revision benefits the general interest of Users
(2)When the revision is reasonable and does not contradict the purpose of the contract between the Contractor and the Service Providers
2.If the Service Providers revise this privacy policy, they shall notify Users of the revision, the contents of the revision, and the effective date by posting it on the Service site or other sites managed by the Service Providers.
